UK Student Visa - Tier 4 PBS - Advice



Please note: The rules and process of the UK immigration system is continuously changing and this advice may not be valid in the future if/when the rules change again.

**This post only applies to non-EU (excl. Switzerland) students wanting to apply/extend their student visas**

Disclaimer: The UK immigration system is a very complicated process and if you need help, please go to an OSIC registered adviser and please do not rely on my post.


This is my second post on the topic of student visas for non-EU students. This time, I would like to focus on what to do when things go wrong.

This can go wrong surprisingly easily. When I mean "go wrong", I mean being refused a visa and/or told to leave the country. You might think "this will never happen to me" but it does happen and much more frequently to unsuspecting students who are careless in their application.

Let's look at the case of my friend from Hong Kong, let's call him F. F is a full time student in the UK, his visa was almost expiring so he applied for an extension whilst in the UK. F filled out everything, F remembered to include his CAS (Confirmation of Acceptance for Studies) which was implemented recently. F also remembered to include bank statements showing F had funds and of course, photos. F also went all the way to Croydon to submit his biometric details. A couple of weeks later, F's application came back with his passport and a letter explaining that his application had been refused. This was because F had provided the "wrong" photos. By now his original visa had expired but the UKBA told F that he can re-apply in the UK. So F got the "correct" photos and he sent the application back with all the documents including his bank statements.

What F didn't realise was that F was making a "fresh" application by re-applying. A couple of weeks later F's application came back (once again) with a letter explaining that F's application had been refused. This was because F had provided bank statements that were out of date. The bank statements may have been valid when he applied the first time but it was now out of date as he was making a new application when he re-applied. This time F did not get back the passport, the immigration officials kept it. He was not given a right of appeal or admin review as F had re-applied when his original visa expired making it an "out of time" application. F was told he had no right to live in the UK and was an illegal immigrant, he had to leave immediately. But F did not have his passport. F had to buy flight tickets and then F had to call the UKBA to prove he had a ticket and his passport was released. F eventually got his visa back home.

This can not only happen due to wrong photos but also due to wrong bank statements. This case also emphasises the importance of making an application BEFORE your visa expires as this will get you the right of appeal or admin review.

There is also a little known application called Long Residence Indefinite Leave to Remain (ILR). ILR is basically a permanent residence visa a bit like the Green Card. You normally get ILR through family or work but you can also get it just for living in the UK for 10 years (or 14 years if you are an illegal) This is continuous residence and should not include gaps created by making an application when your original visa has expired. **UPDATE IMPORTANT** : If you are looking to do some part-time jobs whilst studying in the UK please read.

As an adult student under Tier 4 (General), you are allowed to:

  • do part-time work during term time;
  • do full-time work during vacations;
  • do a work placement as part of your course;
  • work as a postgraduate doctor or dentist on a recognised Foundation Programme; and
  • work as a student union sabbatical officer for up to two years.

The maximum amount of part-time work you can do during term time is:

  • 20 hours per week if you are studying a course at or above UK degree level or a foundation degree course, and/or if you made your application to study under Tier 4 (General) on or before 2 March 2010; or
  • 10 hours per week if you are studying a course that is below UK degree level and is not a foundation degree course, and you made your application to study under Tier 4 (General) on or after 3 March 2010.

The work you do must not fill a full-time permanent vacancy (other than on a recognised Foundation Programme), and you must not be self-employed, employed as a doctor in training (except on a recognised Foundation Programme) or as a professional sportsperson (including coach) or entertainer.

You can work full-time during vacation periods, within the above limits. If you have completed your course and you make an application to remain in the UK under the points-based system before your existing permission to stay expires, you can work full-time (within the above limits) until your application is decided.

As for your family and dependents, if your course is 12 months or more, they will be allowed to work.

The new government has announced new measures, however they have not yet been implemented. Ideas include a compulsory Private medical insurance for students to prevent them from using the National Health Service and a "deposit" which involves a student depositing a sum of money to the government and the student gets the money back when he/she leaves the UK. You now need to know English to study English as a Foreign Language and when you arrive the immigration officials will make sure you know how to speak it!

As you can see, this is a continuously revolving system and it seems the only way this is going is to limit the number of non-EU students as much as possible.

  1. Thank you for this post it demostrates the complexity of the application process for VISA and thats how many of us get into trouble.
    i have a similar experience as your friend F " not submitting a certificate" and i have been given 10 days to appeal or make a fresh application. but upon return of my documents the visa has expired and i dont think i have grounds for appeal since i failed to submit the certificate( even though i was advised to the effect by a lousy admin intern at my uni that CAS covers the application). If i make a fresh application within the 10 days would that be ragarded as " out of time " application?

    I am quite confused about the new rules can you please guide me on the following:

    1. Is it a good choice to show the statements of my Legal Guardian in case my personal statements and that of my parents don't fulfill the 28 day condition?
    2. What documents will be required to prove someone as my Legal Guardian?
    3. What does the term international company mean in the new description of Official Financial Sponsor for Tier 4 students?
    4. What documents will be required if I am being sponsored by a company?

    1.Your parents should be your legal guardian. If your parents are your legal guardians then they need to meed the 28 day requirement.

    2. If you have court papers (from divorce, adoption, foster etc..) then show them that to show who your legal guardian is. If you have non they will assume that your biological parents are your legal guardians.

    3.If you are being sponsored by an International company such as Microsoft, Pepsico, App inc... etc.

    4. Letters...their financial documents showing they have sufficient funds.

    the Certificate of Aceeptance (CAS) is a compulsory requirement. Your educatioal provider should issue you with one.

    But if I got sponsorship from the Ministry of Agriculture, I need only an offical letter? In the letter should be stated that they will finance me for the current year or for the two year master period?
    Also, for Tier 4 visa do I need to show health insurance?

  7. I'm not too sure on that i'm afraid. However you DO NOT need a health insurance for UK as a student. Currently the NHS covers you as long as you have a valid visa. However you may consider getting a private medical insurance as the services provided by the NHS may sometimes be a bit poor.

    Thanks for the informative post. I have a question regarding my visa. I'm currently on tier 4 student visa and will be applying for a tier 1 vis in mid November (this time I will have had passed my degree). However, as my passport expires on April next year, I don't wish to get my tier 1 visa stamped on it so, will get a new passport soon. My question is, do you know whether I can apply for a tier 1 visa including my 2 passports with the application i.e old (cancelled) one with a tier 4 stamp and new passport with no stamp? I've been trying to get answers on this matter, so any comments are highly appreciated. I even called the UKBA many times and I'm not very satisfied with their answers cos they are all confusing. Please let me know if anyone has any information on the matter

  9. Thanks for the informative article. I have a question and hope someone can help. I'm currently on tier 4-student visa and will be applying for a tier 1 Visa in mid November (this time I will have had passed my degree). However, as my passport expires on April next year, I don't wish to get my tier 1 visa stamped on it so, will get a new passport soon. My question is, do you know whether I can apply for a tier 1 visa including my 2 passports with the application i.e old (canceled) one with a tier 4 stamp and new passport with no stamp? ( i know I could ask for a transfer of condition thing, but its too expensive). I've been trying to get answers on this matter, so any comments are highly appreciated. I even called the UK-BA many times and I'm not very satisfied with their answers cos they are all confusing. Please let me know if anyone has any information on the matter, or anyone who had been in a similar situation. Thank you so much in advance

    Just include your two passports when you apply and they will place the Tier 1 visa in your New Passport.

I made a stupid mistake while filling the tire4 appendix 8 form. 5.8. question is are you going to study non English language courses, I understood as I am not going to study English in UK, instead check "no", I checked "yes" and indicate I am an American and met the English language requirement below. Do you think this mistake will cause a rejection?

  12. Thank you for your article. I have a problem which I hope you can guide me with. I have applied for my Tier4(G) visa extension last year (2009) October just before it expired. It was sent back to me due to insufficient funds/biometric. I did have my funds in my bank but apparently this can be caused by a confusion in reading my account number. I did not realise my application was rejected until now ( i was very ignorant and i hate myself for it now) and have reapplied now just before leaving to go back home and they have refused due to not having CAS number. My university can't give me a CAS number because I have finished my course and now it seems that I have stayed in England without a visa for the past one year. I have looked into getting a Tier 1 visa but my university advisors say I need to have funds worth £800 in my account for the past three consecutive months which I don't. I can show that my parents are supporting me and my sister as well who is working as a doctor in England. I am stuck as I don't want to be seen as being here illegal and be banned. They have sent back the appplication that I have just made requiring a CAS number although I have included with my application a letter stating that I have just finished my course and showed proof that I have applied before, had funds and my parents have supported me and also that I have passed my degree.

    I posted my tier 4 visa extension application on 6th Sept wih Application version 07/10 which was on UKBA website. Now I read today application made on or after 6th September should use version 09/10 which was not on their website at the time. Do you think it will affect my visa? Pleas advise. Thans

    Thanks for this post, it helps a lot. I just wanted to ask, that from the link you gave for the rules of getting the right photographs, it says that spectacles are acceptable, but it is preferred not to wear them. I had given photographs in which I mean wearing spectacles, as I need them and while submitting the documents, the representative at VFS (I have applied from India) said that the photographs were acceptable. Is it still possible that my visa might be rejected on the grounds of the photographs? I had applied for visa on 19th August and still not got a reply and wanted to know whether there could be any such problem.

    I will be studying an international foundation programme and then proceeding to a degree level course at the university of kent. In my visa application form, should I put it under foundation degree or as a degree level course? im very confused with this.

  16. i have applied for tier 4 general student, but they said i should go and produce my CAS no from my school, but the school did not get it for me on time, and they refused my application and my passport was returned to me. But, my current visa has just expired now and i have got the CAS no, can i put it in a fresh application because my current visa has just expired?

  17. Hi , I am planning to apply for Tier1- General highly skilled ( PBS ) . Just want to know , if it is really required to apply through a local Visa agent. I dont find any significant value addition which the Local agents Provide compared to the fees they charge.

  18. hello,,this information is very helpful.My question is that being recently divorced, what documents do I need to submit with my application for tier4 gen student visa to the Uk, considering my parents would be sponsoring me for the studies.Do I need to change my passport and identity card, considering most of my documents carry my ex husbands name. What are the requirements to apply for tier 4 student visa in this situation also with a dependant my 3 year old daughter.

  19. I applied student visa for UK on 11 Jan 2011. I submitted VAF9 from and PBS appendix 8 TIER 4 (General) student Self Assessment form with my complete origional documents.Mistakenly i made the following human error in my applications form.

    1. I entered the wrong date 11/02/2011 in my application forms.It should be 11/01/2011.

    2.Mistakenly in TIER 4 (General) Student Self Assessment form i didn't put a cross in the box of part 5.1, and 5.4.

    Do u think this mistakes will cause a rejection of my application process.

    My visa expires on 21st Jan 2011 and my course finish by 31st Jan 2011,If i submit the application with required documents can I get visa extension or not.

    Or did i need to extend my project extension and then apply for the CSA number.
